Terms and Conditions 

These terms and conditions (the “Agreement”) govern the purchase of products (the “Product”) by you the “Customer/client” from the seller of the Product (“we,” “us,” or the “Company – Xtra Spaces“).

On the day of installation please provide ample power for our tradesmen. Our machines require significant amounts of power, and there should be no other trades using or working within the vicinity of our tradesman. 

Connecting power must be sourced from the house – a builder’s pole at the front of the property will not provide adequate power to run multiple machines. If power is not available, a generator can be provided at an additional cost. This must be organised ahead of the start date.

In most installations the material will arrive on the same day as the tradesman who will be erecting the Pod, on occasion the materials may need to be delivered prior, in these instances please have the materials placed in a safe and secure position, please note that once the materials are delivered to site the ownership transfers to the customer, so if they are damaged or stolen it will be up to the customer to replace them and not the responsibility of Xtra Spaces.

Our quotes unless otherwise specified are for the Pod to be erected on a level surface, plus or minus 100 mm if additional earthworks are required they will be charged at $110 per hour per tradesman including Gst.

Please ensure you have clearly defined where the Pod is to be erected, this will ensure it is placed in the correct position.

Ideally Pods are erected on top of a concrete slab or over prepared footings or piers. In instances where their is no slab or footing Xtra Spaces will provide concrete blocks to go on the ground and levelling boots, please note Xtra Space takes no responsibility for any ground movement under the Pod.

Please advise clearly where you would like windows and doors located. If no direction is given, Doors and Windows will be placed in standard positions. If you have sliding doors as part of your installation, please advise if you require the door to open in the opposite direction to standard, note this must be done at the time of ordering.

1. Stacker Door Orientation

1.1 Standard Orientation The standard orientation for stacker doors will be as follows:

  • For three stacker doors: left to right hand slide from the exterior of the pod.
  • For sliding doors: Right to left hand slide from the exterior of the pod.

1.2 Modification of Orientation In the event of any modifications or variations to the standard door orientation, it is the responsibility of the customer to ensure that such modifications are explicitly documented in the deposit invoice or any invoices following a deposit invoice.

2. Acceptance of Stacker Door Orientation

2.1 Deposit Invoice The deposit invoice issued to the customer shall serve as the primary document specifying the stacker door orientation for the pod installation.

2.2 Customer’s Acknowledgment By paying the deposit invoice, the customer hereby acknowledges that they have read, understood, and agreed to the stacker door orientation as specified in the deposit invoice. The customer acknowledges that the stacker door orientation is in accordance with the standard orientation mentioned in Section 2.1 or any modifications outlined in the deposit invoice.

3. No Previous Email or Message History This Agreement supersedes and takes precedence over any previous email history or messages exchanged between the parties regarding the stacker door orientation.

As mentioned previously once the material are on site they become the property of the customer, this includes all offcuts. These remain with the owner at completion of the Pod, If you don’t want to keep them for other projects,  please provide a suitable place for our tradesman to place them or a bin to put them in. If you would like us to remove them for you please contact our sales team ahead of time so we may give you a quote to dispose of it for you.

Full payment is due no later than on the day of commencement for works to be completed. 

It is the responsibility of the owner to comply with local councils regulations and by laws. If you have any questions please don’t hesitate to contact us, we will be more than happy to assist you.

Warranty:

This warranty covers the waterproofing of your Modular pod for a period of one year from the date of installation. If, during this time, any water infiltration or leakage is found to be the result of a failure of the waterproofing system installed by us, we will repair or replace the affected areas at no cost to you.

This warranty does not cover damages caused by external factors such as storms, floods, or improper maintenance by the homeowner. It also does not cover any pre-existing conditions or damages that were not addressed prior to the waterproofing installation.

This warranty does not cover damages caused by accidents, misuse, abuse, neglect, improper handling, alteration, modification, or repair by any person or entity not authorised by the manufacturer. 

The company shall not be liable for any damages caused by the negligent acts of its employees, unless such damages were caused by the ‘gross’ negligence or wilful misconduct of the company. The company shall not be liable for any damages caused by the actions of its employees while acting outside the scope of their employment. 

The Company will not be liable for any damages of any kind arising from the use of the Product, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

The company shall not be held responsible for any damages or defects resulting from ground movement affecting the structure. The company shall not be liable for any repairs or replacements necessary as a result of such ground movement. 

If in the event a claim must made, the claim must be filed under this warranty, please contact us at (sales.xtraspaces@gmail.com) and provide proof of the date of installation and any relevant documentation. Our team will then assess the issue and provide a resolution as soon as possible. This will be done through a thorough inspection of your Modular Pod by one or more of our team members from Xtra spaces. At which point once Xtra spaces has a solution it will immediately brief the owner of the its solution.
